– The Supreme Court on Friday deliberated over the future of TikTok in the United States, as justices weighed the balance between national security concerns and freedom of speech. The case revolves around a law requiring ByteDance, TikTok’s Chinese parent company, to divest its U.S. operations or face an outright ban.

The two-and-a-half-hour session featured heated arguments about the implications of banning the app, which is used by an estimated 170 million Americans. While some justices appeared inclined to uphold the law, the case underscores the tension between safeguarding national security and preserving digital free expression on a scale never before addressed by the court.

The Biden administration has framed the issue as a critical matter of security, citing the potential for the Chinese government to exploit TikTok to collect data on Americans or influence public opinion. “As long as ByteDance owns TikTok, U.S. national security remains at risk,” said Solicitor General Elizabeth Prelogar during her arguments.

TikTok’s lawyers and representatives of its creators countered that banning the app would violate First Amendment rights by depriving users of their preferred platform for expression. They argued that the government had failed to provide sufficient evidence of an immediate threat.

The debate comes as an American internet advocacy group, led by billionaire Frank McCourt, has offered to purchase TikTok’s U.S. operations from ByteDance in an effort to prevent the ban.

Unless the Supreme Court intervenes, TikTok could vanish from Google, Apple, and other platforms by January 19, leaving millions without access. The decision carries significant implications not only for TikTok users but also for how the U.S. balances technological innovation, global competition, and constitutional rights.
